Protected Persons Applications
A protected person application is filed for individuals who are unable to return to their country of origin due to past persecution and/or a well-founded fear of future persecution based on their race, religion, nationality, membership in a particular social group, or political opinion. Applicants seeking this application must demonstrate that their country is unable or unwilling to provide the individual with adequate state protection. Humanitarian and Compassionate Grounds Applications
To qualify for this protection, applicants must clearly demonstrate that they would experience unusual and underserved or disproportionate hardship if they were required to leave Canada. These applications can be difficult, but for certain individuals who are unable to leave Canada, it is a path that can lead to permanent residency. Immigration Division Litigation
We assist clients with admissibility hearings, which occur when individuals are either trying to enter Canada and are believed to be inadmissible, or if an individual is within Canada facing removal based on belief of inadmissibility. Immigration Appeal Division Litigation
The Immigration Appeal Division Litigation generally involves cases where applicants appeal failed sponsorship applications, residency obligations, or removal orders. Our office has experience in this field and is able to help you if you are facing these proceedings.
Refugee Protection Division
Serving as a tribunal branch of the Immigration and Refugee Board, the Refugee Protection Division hears matters from individuals claiming protected person status. These claims can be made at various locations, including ports of entry, the IRCC, or a CBSA office in Canada. Generally, these claims are made either under the grounds of a convention refugee or a person in need of protection. Refugee Appeal Division
Refugee claims which are unsuccessful at the Refugee Protection Division can be appealed and be heard by the Refugee Appeal Division. This tribunal branch of the Immigration and Refugee Board allows the individual an opportunity to prove their case before a panel, typically through written submissions.
